These Terms of Service ("Terms") are an agreement between you and Up Your Bids LLC, operating the GovData service ("GovData," "we," "us," "our"). By requesting a report, subscribing to monitoring, or using this site, you agree to these Terms. If you do not agree, do not use the service.

1. What GovData is

GovData builds research products from public government records — the minutes, agendas, ordinances, and property records that cities and counties publish. We collect those records, structure them, and deliver reports about what government boards have actually decided: rezonings, variances, special exceptions, annexations, and related land-use actions. Every fact in a GovData report cites the government document it came from.

2. We report history. We never predict.

GovData reports what happened. We do not predict what any board, council, or agency will do. Historical approval statistics describe past decisions by past boards on other properties. They are not a probability, forecast, or opinion about your property or your application. Land-use decisions are discretionary and are made by the government bodies that hold them — not by us, and not by our data.

3. No government affiliation

GovData is a private research service. It is not a government agency and is not affiliated with, endorsed by, sponsored by, or connected to any federal, state, or local government or any government entity. The records we use are public documents; our use of them does not imply any government relationship, and a GovData report is not an official statement of any jurisdiction.

4. Accuracy — what we promise and what we don't

We take accuracy seriously: we measure it, publish our methodology, and correct verified errors with an attributed correction record. But government records can be amended, superseded, or corrected by the governments that hold them, and extraction from documents can contain errors. A GovData report is a research aid, not a substitute for the official record. Before you act on any fact in a report — especially in a purchase, sale, or application decision — verify it against the cited source document or with the jurisdiction. If you find an error, tell us; we will check it against the source and correct it if the source disagrees with us.

5. Not professional advice

Nothing GovData produces is legal, financial, tax, investment, engineering, or other professional advice, and no attorney-client or other professional relationship is created by using the service. Consult your own professionals before making decisions about property.

6. Not a consumer reporting agency

GovData is not a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), and our reports are not consumer reports. You may not use GovData, in whole or in part, to determine any individual's eligibility for credit, insurance, employment, housing tenancy, or any other purpose covered by the FCRA, or to take any adverse action about any individual. Our products are about properties and public government proceedings, not about people.

7. Your license — what you may and may not do

When you purchase a report or subscription, we grant you a limited, non-exclusive, non-transferable license to use it for your own business purposes, which includes sharing a report (or excerpts, with attribution to GovData) with your own client, partners, lender, or advisors as part of your work product on a specific matter or property.

You may not: resell, republish, or redistribute GovData reports or data as a product; systematically copy, scrape, or bulk-extract data from the service; use the service or its output to build, train, or seed a competing database or data product; or remove citations or attribution. One license covers one business; if your firm wants multiple seats, contact us.

8. Freshness

Public boards meet on their own schedules, and coverage is stated per source on our coverage page. A report reflects the records we hold as of the date printed on it. Monitoring subscriptions deliver updates as we ingest new records, not in real time.

9. Payments and refunds

Prices are shown before you buy. Payments are processed by Stripe — we do not see or store your full card number. If we fail to deliver a purchased report, we will re-deliver it or refund it. Except where required by law, delivered reports are non-refundable (they are information — they can't be returned). Subscriptions can be cancelled anytime and end at the close of the paid period.

10. Acceptable use

Do not use GovData to break the law, infringe others' rights, harass or profile any individual, misrepresent our reports as government documents, interfere with the service, or attempt unauthorized access. We may refuse or cancel service to protect the service, our sources, or compliance with law.

11. Our platform is ours; the public record is everyone's

The underlying government records are public. GovData's compilation, structure, software, analysis, branding, and the reports we generate belong to Up Your Bids LLC and are protected by intellectual-property and contract law. Your license to use them comes from these Terms and ends where these Terms say it does.

12. Third-party services

We rely on third-party providers (hosting, payment processing, email delivery). Your use of the service may be subject to their terms, and we are not responsible for their acts or omissions.

13. Disclaimer of warranties

The service and all reports are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Our published accuracy measurement describes our testing methodology and results; it is a description of our process, not a warranty of any individual fact.

14. Limitation of liability

To the fullest extent permitted by law, Up Your Bids LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost deals, or lost data, arising out of or relating to the service or any report. Our total liability for any claim will not exceed the amount you paid us in the three months before the claim arose.

15. Indemnification

You agree to defend and indemnify Up Your Bids LLC from claims, losses, and expenses (including reasonable legal fees) arising from your use of the service, your work product incorporating it, or your violation of these Terms or of any law.

16. Termination

You may stop using GovData at any time. We may suspend or end access for violation of these Terms or for legal, security, or operational reasons. Sections that by their nature survive (license limits, ownership, disclaimers, limitation of liability, indemnification, governing law) survive termination.

17. Changes to these Terms

We may update these Terms; the "last updated" date will change when we do, and material changes take effect when posted. Continued use after a change means you accept it.

18. Governing law and venue

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts in Charleston County, South Carolina, and you consent to that jurisdiction.
